Dear Mr. and Mrs. Van Der Zalm:
Thank you for writing. I am so sorry this has become such a quagmire.
I now take this means of contacting you since our telephone conversation somehow got disconnected a few minutes ago.
I found out 2 weeks ago that Nick Jerns promised the Mariner's Cove HOA there would never be Portapots in front of their homes after 2002. (Quite unfortunate this information was not relayed to the new BBCC BOD!) George Emmett forwarded the information to the Chamber in a letter dated May 28, 2005, for which I was very thankful. I was not able to answer his concerns until I had to time write a letter on June 7.
We have not been ignoring the situation. I have worked diligently at getting this problem resolved, but have been waiting for responses for some people I've dealt with, and could not get ahold the owner of Birch Bay Teriyaki to give him the option of placing the P-A-P near his restaurant.
Today, after 3 phonecalls, I finally left the office and went to his other place of business, Beachwood General Store, and spoke with him. After several minutes of discussion, at 4:45 I got an answer that would allow me to make a final decision about the P-A-P.
When I returned to the Chamber office, I called the P-A-P office at 4:57pm and asked them to remove the unit ASAP. Everyone will be happy to know they said this would most likely occur Tuesday or Wednesday of this week.
Please accept our apologies for the email you received; Yvonne thought she was writing to me because she saw my home email address.

Subject: Port a Potty
My name is Peter Van Der Zalm, I am the owner of unit #240 - 8026 Birch Bay Drive. The reason that I am contacting you is the port a potty that is stationed directly in front of my unit. In early 2003 the Mariners Cove Home Owners Association met with Representatives of Whatcom County Parks and The Birch Bay Chamber of Commerce, I was present at this meeting. The meetings discussed the video and photos of drug dealing and the general use as a late night hang out at this port a potty. An agreement was reached that this port a potty would be relocated to an area that did not block the views and submit the residents to late night drinking and drug dealing. I would hope the Chamber would live up to agreements that previous Chamber Boards had made. The homeowners at our Annual General meeting asked George Emmett to remind the Chamber of our agreement reached. He seems to have been ignored as the port a potty is still in place. I trust you will honor this agreement and have the unit moved.
Thanking You in Advance
Peter Van Der Zalm
